Information society service providers that store and provide to the public access to large amounts of works or other subject-matter uploaded by their users shall, in cooperation with rightholders, take measures to ensure the functioning of agreements concluded with rightholders for the use of their works or other subject-matter or to prevent the availability on their services of works or other subject-matter identified by rightholders through the cooperation with the service providers. Those measures, such as the use of effective content recognition technologies, shall be appropriate and proportionate. The service providers shall provide rightholders with adequate information on the functioning and the deployment of the measures, as well as, when relevant, adequate reporting on the recognition and use of the works and other subject-matter.

So the European parliament yesterday voted with a majority against this law, but apparently that only means that in September they will slightly modify it and then put it up for vote again... The lobbyists clearly never give up :evil:
Democracy has become a farce.

Article 13 is a provision in the proposed EU Copyright Directive mandating that all content uploaded to the internet be monitored and potentially deleted if a likeness to existing copyrighted content is detected. This provision will be voted on by the end of 2018.

If you are a creator or independent business, the content that you upload to share with your audience might be deleted without your consent. Creators include but are not limited to artists –such as cartoonists, gamers, illustrators, photographers, documentary filmmakers, animators, musicians, DJs, and dancers,– bloggers, journalists, and technologists.

Online platforms will be required to implement complex and expensive filtering systems and will be held liable for copyright infringement, potentially incurring fines that threaten their economic viability.

Article 13 would restrict the ability of Internet users to consume content – meaning they won’t be able to find and enjoy diverse kinds of cultural expressions that they have grown accustomed to. The days of communicating through gifs and memes, listening to our favourite remixes online or sharing videos of our friends singing at karaoke might be coming to an end.

Ultimately, the internet culture that has emerged in recent years – a culture that enables connections and democratises information – will become bureaucratic and restrictive.

The reform was approved today with minor changes with respect the original text, which I still have to fully inspect. It seems like there are more and clearer exceptions, but overall I think the attack surface through false legal claims on Open Source projects has overall widened. It will be hard to understand the impact of this, given that most of the implementation is left to single member states to handle.

Yes, however the text that will be discussed later on has both Article 11 and 13 inside. I would have preferred to not have them at all at this point. The risk of having them in the final law is much higher now. To my understanding it is either the articles are rejected by negotiations with the member states or the whole reform gets rejected at the final vote. I think the member states are overall favorable to 11 and 13, while just 2 articles in a whole otherwise OKish reform might not be enough to force a rejection.

After years of controversy over the new EU Copyright Directive, everything should suddenly go mega-fast in the last few metres. In view of increasing public protests against Article 13 and the associated upload filters, conservatives in the EU Parliament are now pushing the pace. The chairman of the EPP parliamentary group, Manfred Weber (CSU), wants to request on Thursday in the round of parliamentary group leaders to bring forward the decisive final vote to next week.

From what I understood by reading a few things in the last days, the reform they are currently pushing for approval is even worse that what it originally was. Forums, like this one, are gonna be impacted. I will try to find the references I was reading and post them here.

The rise of populism and the like makes hard to say this nowadays, but I am always been a proud European. And this time the EU is really letting me down. I am disappointed beyond any reasonable limit by this whole Article 13 madness.

I agree wholeheartedly.

While intended to protect content creators, both article 11 and article 13 will make it almost impossible for smaller platforms to exist online - inevitably leading to the few "big players" (google, facebook, etc) further cementing their monopoly - and their position of power over the very content creators we wanted to protect against them...

In Germany and possibly throughout the EU, services such as Tor may no longer be legal for long?
